GymPact Terms of Service

These terms are the agreement between you and GymPact. By creating an account you're agreeing to

them. We've kept them as short and readable as we can.

1. What GymPact is

GymPact is a mobile app that helps people who go to the gym find a community there. You can join

gym-specific communities ("Gems"), share a feed and group chat, keep a check-in streak, log your

sleep, and organise events with other members.

GymPact is not a fitness, medical, or nutritional service. See section 6.

2. Your account

You need to be at least 13 years old to use GymPact.

You're responsible for keeping your login details secure and for everything that happens under your

account. Tell us immediately if you think someone else has access to it.

Give us accurate information when you sign up. Don't impersonate someone else or create an account

on another person's behalf without their permission.

3. Your content

Anything you post — messages, feed posts, events, photos, your profile — remains yours. You

keep ownership of it.

By posting it in GymPact, you give us permission to store it, display it to the other members of

the relevant Gem, and process it as needed to run the app. That permission ends when you delete the

content or your account, except for copies already saved by other users or held in routine backups.

You're responsible for what you post. Only post things you have the right to post.

4. Rules of the community

GymPact exists so people can find training partners and friends. Don't wreck that for others.

Don't:

• Harass, bully, threaten, or abuse anyone
• Post hateful content targeting people for who they are
• Post sexual content, graphic violence, or anything illegal
• Share other members' personal information without their consent
• Photograph or record people at the gym without their permission
• Spam, advertise, or promote unrelated products or services
• Impersonate other people or misrepresent your connection to a gym
• Try to break, overload, reverse-engineer, or gain unauthorised access to the app or its systems
• Scrape or bulk-collect other members' information
• Use GymPact for anything illegal

Gems are private-ish, not secret. Anything you post in a Gem is visible to every member of that

Gem, and members can join freely. Don't post anything you'd be upset to see shared.

If you break these rules we may remove content, suspend your account, or delete it — depending on

how serious it is. We'll try to be fair and, where reasonable, tell you why.

5. Gyms, Gems, and who runs them

Anyone can add a gym and create a Gem for it. Adding a gym to GymPact does not mean the gym

endorses, sponsors, or is affiliated with GymPact, and we don't verify that the person who created

it has any connection to the business.

Gem creators become that Gem's admin. They're responsible for how their community behaves, but they

are not our employees or agents, and we're not responsible for what they do.

We may remove gyms or Gems that are fake, duplicated, abusive, or created to mislead.

6. Health and safety — please read this one

GymPact does not give medical, fitness, or nutritional advice. Nothing in the app — not the

workout split you set up, not the sleep target we suggest, not the weather tip, not anything another

member tells you — is professional advice.

The suggested sleep target is a rough figure based on general age-band guidance. It is not a

clinical recommendation.

Talk to a doctor before starting or changing an exercise programme, especially if you have any

health condition, are pregnant, or are recovering from injury. Exercise carries risk of injury and

you take that on yourself.

Events organised through GymPact are organised by members, not by us. Hikes, runs, camping

trips and meetups are arranged between members. We don't vet, supervise, insure, or take any part

in them. You attend at your own risk. Use normal judgment about meeting people you've met online:

meet in public first, tell someone where you're going, and leave if something feels wrong.

7. Matching

Matching is optional and separate from the rest of GymPact. You are never in it unless you turn it

on, and turning it off removes you from it.

You must be 18 or over to use matching. This is enforced by our systems, not just asked of you.

Everything else in GymPact remains open to members aged 13 and over.

What we will not show about you. A matching card never carries your gym, your Gem, your

location, any distance, your training schedule, or whether you are at the gym. That is a safety

decision and we will not relax it. If you want someone to know where you train, tell them yourself.

How you must behave. The community rules above apply here too, and in particular: no sexual

content, no harassment, no contacting someone who has not matched with you, no pretending to be

someone you are not, and no using matching to advertise anything. We will remove accounts that do

these things, and we do not owe a refund for a paid plan ended this way.

We do not verify anyone. We do not run background checks, confirm identities, or check that a

photograph shows the person who uploaded it. A match is not a recommendation and is not a

safety assurance from us.

Meeting people. If you arrange to meet someone, meet somewhere public, tell someone you trust,

and stop if you are uncomfortable. You do this at your own risk. Nothing in these terms makes us

responsible for what another member does.

No guarantees. We do not promise you any matches, any particular number of them, or that anyone

will reply. Paying for the plan lets you see who matched with you; it does not make matches happen.

Leaving. Turning matching off deletes your card, your matching photos and the likes you cast.

8. Paid features, payment and refunds

The community is free, and stays free. Joining GymPact, joining a Gem, posting, chatting,

events, check-ins and streaks cost nothing, and we do not intend to put any of them behind a

payment. We do not run ads.

We intend to offer an optional paid plan covering extras that sit beside the community rather than

gating it — decorative animations and themes, AI-assisted features, and seeing who matched with

you. You never need it to take part in the community.

Payments are not currently active. No payment processing exists in the app today, no card or

bank details are collected, and nothing in these terms authorises us to charge you. If we turn on

billing, we will tell you clearly before it applies and you will have to agree to it before any

charge is made.

Refunds, when paid plans exist. Any subscription would be sold through the Apple App Store or

Google Play, which means **Apple or Google takes the payment and handles refunds under their own

policies** — not us. We cannot issue, refuse or see a refund on your behalf. To request one, use

Apple's *Report a Problem* page or Google Play's refund process. You would cancel a subscription

the same way, in your App Store or Google Play account settings; deleting the app does not cancel

it.

Where the law where you live gives you a right to cancel or a right to a refund beyond those

policies — for example a statutory cooling-off period — that right stands regardless of what this

section says, and we will not try to talk you out of it.

9. The app is provided as-is

We work hard to keep GymPact running, but we provide it "as is" without warranties of any kind.

We don't promise it will always be available, error-free, or that it will meet your particular

needs.

We may change, add, or remove features. We may suspend or discontinue the service. If we shut down

permanently, we'll give you reasonable notice and a way to get your data.

10. Our liability

To the fullest extent permitted by law, GymPact is not liable for:

• Injuries sustained while exercising or attending member-organised events
• Anything another member says or does, in the app or in person
• Loss of data, profits, or content
• Indirect, incidental, or consequential damages

Where liability can't legally be excluded, it's limited to the greater of the amount you've paid us

in the last 12 months (currently zero) or US$50.

Nothing here limits liability for death or personal injury caused by our negligence, fraud, or

anything else that can't be limited by law.

11. Ending things

You can leave any time — Profile → Delete Account removes your account and everything in it,

immediately and permanently. Or email support@getgympact.com and we'll do it for you.

We can end your access if you break these terms, if we're legally required to, or if we shut the

service down. Except for serious violations, we'll give you notice.

12. Changes to these terms

We may update these terms. If a change materially affects your rights, we'll notify you in the app

before it takes effect. Continuing to use GymPact after that means you accept the new terms.

13. Legal bits

These terms are the whole agreement between us about GymPact.

If any part of them turns out to be unenforceable, the rest still applies.

If we don't enforce something immediately, that doesn't mean we've given up the right to.

You can't transfer these terms to someone else. We can transfer them if GymPact is acquired or

reorganised.

Governing law: these terms are governed by the laws of the State of Delaware, USA, without

regard to its conflict-of-laws rules, and disputes will be handled in the state or federal courts

located in Delaware.
